FENTANYL QUI TAM FALSE CLAIMS ACT

Richard Hollawell, along with co-counsel, obtained a $9 Million settlement in May of 2023 from private equity firm Belhealth Investment Partners and its principals and their portfolio companies, Linden Care and Quick Care, to settle allegations involving False Claims Act violations in a qui tam complaint that Defendants unlawfully distributed Subsys, a potent, rapid-onset fentanyl sublingual spray, in violation of the Controlled Substances Act, 21 C.F.R. Sec. 1306.04(a).

The United States Department of Justice declined to intervene in the case in 2018 against the Defendants and Mr. Hollawell and his co-counsel litigated the case, conducting discovery, depositions and mediation which led to the settlement. 

The case is very notable for the successful resolution with a private equity firm because of the high legal hurdle in the case to prove that Belhealth exerted day to day control over its portfolio companies, Linden Care and Quick Care Pharmacies. The case is captioned United States ex rel. Jane Doe v. Insys Therapeutics, No. 2:16-cv-7937-JLS-AS (C.D. Cal.).

Improper prescribing of opioids and other Controlled Substances by a physician in MA results in $4,000,000.00 settlement.

A 39 year old mother, wife, daughter and friend to many was continually prescribed opioids and other Controlled Substances despite the physician being aware that the patient became addicted to the highly addictive prescription medication years before the patient’s death.

INJURED BY RECYLING TRUCK

As she was walking, she was struck by a large recycling can that had been jettisoned from the mechanical arm of truck.

It had been dislodged from the holding mechanism and then shot over the truck as the mechanical arms were raised, sailing through the air and striking our client. The injuries to her neck required intensive surgery.

TRACTOR TRAILER CRUSH INJURY

Our client was seriously injured while he was working a tractor-trailer repairman in Carney’s Point, NJ. While the client was under the truck to ensure that the new part installed was properly functioning, the truck driver negligently put the truck in gear which caused the truck to run over and drag the client underneath. We were able to successfully pursue a negligence claim against the trucking company and the truck driver, achieving a settlement of $660,000.

HIT-AND-RUN ACCIDENT

A $635,000 settlement for our client , a minor, who was riding his bicycle when he was struck by a car. The driver then fled the scene leaving him on the side of the road with a serious head fracture and fractured leg. The driver then hid their damaged vehicle in their garage for days until a neighbor reported to police that their car matched the description of the vehicle involved in the accident.

PREMISES LIABILITY

A $600,000 settlement in a case when a minor child was partially blinded when another child threw a stick at him that struck him in the eye. In addition to resolving with the homeowner’s insurance for the child that threw the stick, our NJ personal injury attorneys successfully obtained another settlement with the homeowner where the large pile of sticks remained for months just adjacent to an elementary school as well as the landscape company that left the pile of sticks.

OPIOID ADDICTION

Our client was wrongfully prescribed a fentanyl drug only indicated for end of life break-through cancer pain that caused addiction. The client was only prescribed the potent fentanyl drug for 6 months, but it was devastating, causing the client to suffer with the illness of addiction which required in-patient treatment and rehabilitation. A total settlement of $600,000.00 was obtained for the client who has thankfully been recovering well.

NEGLIGENT OPIOID PRESCRIBING

In 2024, a settlement of $565,000.00 was awarded to the family of a man who tragically passed away from an accidental fentanyl overdose in 2019. The case was filed in 2021 in Pennsylvania against a physician and a pharmacy for their roles in the over-prescribing and improper dispensing of Oxycontin, Xanax and other opioids for many years. The decedent became addicted to the Oxycontin and Xanax and obtained treatment at a rehabilitation center while under the physician’s care. Although aware of the decedent’s addiction history, rehabilitation, and subsequent cessation of Oxycontin and Xanax intake, the physician continued prescribing these medications, and the pharmacy resumed dispensing them. In 2017, the physician’s medical license was suspended, but the decedent was already heavily dependent on the prescribed medications. In 2019, the decedent passed away from an accidental fentanyl overdose.
